Seagull-Experience (collectively, the “Site”, “Website”) is an online service that enables users to research, discover, and book travel experiences across Croatia. Seagull-Experience is operated by Elrem d.o.o., along with its corporate affiliates (collectively, "us", "we", or "the Company").

The Website provides a range of tourist packages, accommodations, excursions, activities, tickets, and other related services (collectively referred to as “products” or “tourist services”) offered either directly by us or through our verified partners and suppliers.

Whether you’re a seasoned traveler or planning your first trip, our goal is to provide you with a user-friendly platform and high-quality service to help you easily plan and book an unforgettable experience in Croatia.

By using this Website, you (“the User”) agree to these Terms and Conditions (“Agreement”) without modification.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR OBTAINING ANY MATERIALS, INFORMATION, PRODUCTS, OR SERVICES THROUGH THIS WEBSITE.

By accessing or using this Website in any manner, you agree to be legally bound by this Agreement and confirm that you understand and accept its terms. If you do not agree to all these Terms and Conditions, do not use this Website or book any services through it.

For all bookings, the individual completing the booking is considered to have accepted this Agreement on behalf of all travelers named in the booking.

We may revise these Terms and Conditions at any time at our sole discretion. Any changes will be posted on this page along with the updated date. Continued use of the Site after such changes constitutes your acceptance of the revised Terms and Conditions.

Privacy Policy and Cookies

We are committed to protecting your privacy. Our aim is to ensure you feel secure when using our Website to explore and book services. We do not knowingly collect personal data from individuals under 18 years of age. If such data is provided, it will be deleted upon discovery.

Use of the Website

As a condition of your use of this Website, you warrant and agree that:

1. All information you provide is accurate, current, and complete;
2. You are at least 18 years old;

We reserve the right to deny access to our services at our sole discretion, including but not limited to violations of these Terms and Conditions.

Prohibited Activities

You agree not to use the Website for any unlawful or prohibited purposes under this Agreement. The content and infrastructure of this Website are proprietary. Except for limited use (such as printing your travel itinerary), you may not copy, modify, transmit, distribute, or sell any material obtained from this Website.

Prohibited actions include but are not limited to:

1. Using the Website or its content for commercial purposes;
2. Making speculative, false, or fraudulent bookings;
3. Using automated means (robots, scrapers, etc.) to access or monitor data;
4. Violating website security measures or bypassing restrictions;
5. Overloading or disrupting the website’s infrastructure;
6. Framing, mirroring, or altering any portion of the Website without prior authorization.

If we detect suspicious, abusive, or fraudulent booking activity associated with your account, we reserve the right to cancel those bookings and pursue legal remedies, including claims for damages and legal fees.

When you use the Website, or send e-mails, messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically and agree that we may communicate back with you in a variety of ways you’ve initiated. Our newsletters require double opt-in to confirm that you really want to be their recipient, and each newsletter contains the link to unsubscribe from the mailing list. You may also ask our assistance to unsubscribe you from all e-mail communications by emailing your request to info@seagull-expereince.com

We welcome your feedback and appreciate hearing from you. However, please note that by submitting any content to us—whether via email or otherwise—including reviews, questions, comments, suggestions, ideas, or similar material (collectively, “Submissions”), you grant us, as well as any affiliated, co-branded, or partner websites through which we offer our services, a non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, publicly display, and perform such Submissions worldwide in any media, whether existing now or developed in the future. You also authorize us to use the name you submit in connection with your Submission, if we choose to do so.

You understand that we may, at our discretion, attribute your comments or reviews (e.g., by displaying your name and location alongside them) and may share your feedback with our supplier partners. You further agree that we may take legal action against any person or entity that infringes upon your or our rights related to these Submissions under these Terms and Conditions.

By submitting content, you acknowledge and agree that your Submission is non-confidential and non-proprietary. We are not responsible for any content you submit, and we assume no liability for it. Furthermore, we are under no obligation to publish your Submission and reserve the right to determine which comments appear on the Website.

If you do not agree to these terms, please do not submit any content.

You are solely responsible for the content of your Submissions, particularly any reviews. You agree not to submit:

- Any content that is unlawful, threatening, defamatory, obscene, pornographic, or otherwise violates privacy or publicity rights or applicable laws;
- Commercial content of any kind (e.g., advertising, promotions, or solicitations);
- Content that infringes on third-party rights, including but not limited to copyright, trademark, patent, or other intellectual property rights.

You will be held solely liable for any damages resulting from your Submissions, including violations of the above restrictions. We reserve the right to use, modify, delete, or decline to publish any content you provide, without prior notice. If you submit multiple reviews for the same experience, we may choose not to publish all of them simultaneously.

We reserve the right to edit, reject, or remove reviews at our sole discretion.

Products and Booking Reservations

By booking any Product through our Website, you confirm that you accept the practices described in this Agreement and in our Privacy Policy. You also affirm that you are at least 18 years old, have the legal authority to enter into this Agreement, and that all information you provide is truthful and accurate. You agree to use this Website solely for legitimate bookings for yourself or for others whom you are legally authorized to represent. Making false or fraudulent reservations is strictly prohibited and may result in denial of services.

Seagull-Experience facilitates bookings for transportation, accommodations, tours, excursions, and other travel experiences that are delivered by third-party providers. By placing a reservation, you agree to engage the services of these suppliers at your own risk. We are not liable for any acts, omissions, errors, representations, warranties, breaches, or negligence by suppliers, nor for any resulting personal injury, death, property damage, or other losses incurred during your interactions with them.

We strongly encourage you to review our Cancellation, (pre)payment, and no-show policies carefully. Verify all relevant details—such as prices, room types, rates, availability, and dates—before completing your reservation, and ensure timely payment where applicable.

Modifying or Amending Your Booking

All change requests must be submitted via email to our Customer Service at info@seagull-experience.com. Requests sent directly to the service provider will not be processed. This applies to any modifications, including date changes, extended stays, early departures, late arrivals, or full/partial cancellations. For cancellations, refer to the “Cancellations and Refunds” section below.

Pricing & Inclusions/Exclusions

Prices shown on the Website include VAT unless stated otherwise. All rates are listed per person unless noted differently.

Prices are subject to change without notice until your booking is confirmed. They generally do not include gratuities for guides or drivers, visa/passport fees, personal insurance, personal expenses, local taxes or duties, or any food or drinks not explicitly mentioned in the “Inclusions” section of the product listing.

Please review all details thoroughly before making a reservation. All listed prices apply only to the specified stay dates and number of guests unless stated otherwise. Promotions or special offers will be clearly marked.

For "on-request" reservations (i.e., bookings not confirmed in real time), we will process your request within two business days (excluding Saturdays). You will be notified in writing about the final availability and price. If you do not receive confirmation within that period, the requested service is either unavailable or could not be processed due to a technical error. You may always contact our Customer Service for verification.

Payment

PAYMENT SCHEDULE

Once your reservation is confirmed, a 30% deposit must be paid within 24 hours (excluding weekends and holidays) for the reservation to remain valid. The remaining 70% must be paid no later than 21 days before your arrival, unless specified otherwise.

For bookings made within 21 days of your arrival, the full amount must be paid within 24 hours (excluding weekends and holidays) to confirm the reservation.

PAYMENT METHODS

Bank Transfer:

If you choose to pay by bank transfer, the required amount must be paid within 24 hours from receiving your confirmation, and proof of payment must be sent to us. Otherwise, we reserve the right not to process your reservation. We are not liable for incomplete reservations caused by missing or delayed payment confirmations. All bank transfer fees are the responsibility of the client (please select "OUR" for charge details). Incomplete payments will invalidate your reservation.

Bank transfer is not available for:

- International payments if arrival is within 5 business days
- Domestic (Croatian) payments if arrival is within 3 business days

In these cases, payment must be made via credit/debit card.

Cancellations and Refunds

When you make a reservation, your payment will be processed as outlined above. If you cancel, any refund or charge will be subject to the cancellation, prepayment, and no-show policy associated with your reservation.

Unless stated otherwise in your booking confirmation, our standard cancellation policy is as follows:

- Cancellations made 30 days or more before arrival: 7% charge
- Cancellations made 29 to 22 days before arrival: 30% charge
- Cancellations made 21 to 15 days before arrival: 50% charge
- Cancellations made 14 days or less before arrival: 100% charge

If your balance payment is not received 21 days before your arrival, or immediately upon booking for last-minute reservations, your booking will be automatically cancelled, and the deposit will be retained per the above policy.

Failure to show up without prior notice will be treated as a late cancellation and incur a 100% charge.

If we are forced to cancel your confirmed booking due to force majeure or service unavailability, we will issue a full refund of any collected payments within 30 days and provide alternative options and updates via email or other communication.

Vouchers

You will receive a personalized booking voucher (“Voucher”) via email for each reservation. You must present this original, valid voucher to the corresponding service provider in order to redeem your accommodation, excursion, or other travel services. Reservations cannot be honored without a valid voucher.

Liability Disclaimer

Seagull-Experience makes no guarantees regarding the suitability, accuracy, or availability of the content, software, products, or services on this Website. All services and content are provided “as is” and “as available”, without warranties of any kind.

We do not guarantee that:

- The Website or services will operate uninterrupted or error-free
- Information presented is accurate or up-to-date
- The Website or communications are free of viruses or harmful elements

You use this Website and all associated services at your own risk. We are not responsible for damages resulting from use of the site or services, including—but not limited to—data loss, hardware damage, system errors, or service interruptions.

We are not liable for the actions or omissions of third-party providers. All such providers are independent contractors, not employees or agents of the Company. Any claims, delays, cancellations, overbookings, or force majeure events beyond our control do not entitle you to compensation or refund, unless explicitly stated otherwise.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its respective officers, directors, employees, and agents from and against any and all claims, causes of action, demands, legal proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and liabilities of any kind or nature, including but not limited to reasonable legal and accounting fees, that arise out of or relate to:

1. Your breach of this Agreement or any referenced documents;
2. Your violation of any applicable law, regulation, or guideline;
3. Your infringement, misappropriation, or violation of any third-party rights, including rights of publicity or privacy;
4. Your use of this Website;
5. Your booking or use of any Products obtained via this Website; or
6. Your negligence or intentional misconduct.

Passports, Visas, and Other Travel Documentation

You are solely responsible for meeting all passport, visa, travel insurance, and health documentation requirements. We disclaim all responsibility for any denial of boarding, travel, or entry into a destination, or for any costs, delays, or losses incurred due to irregularities or deficiencies in such documentation.

If you have questions regarding documentation or insurance, you must contact us well in advance of your trip. Any information we provide in this regard is offered in good faith but without liability on our part.

As visa and health requirements may change without notice, we strongly recommend checking with the appropriate consulate or authority prior to departure.

We also strongly advise purchasing a comprehensive travel insurance policy before traveling. In the event of a cancellation or change in travel dates, your policy may cover cancellation fees and other related costs.

Health Precautions and Safety

We may provide general information regarding required or recommended vaccinations and health precautions for your destination or activity. However, it is your responsibility to confirm these requirements with qualified medical professionals and ensure you have received any necessary or advised vaccinations or medication.

We reserve the right to request proof of such vaccinations or treatments and may cancel your participation—without refund—if these requirements are unmet.

It is also your responsibility to take any required medication before, during, and after your trip. Any health-related information we provide is general in nature and not a substitute for personalized medical advice. You should consult your own doctor with any specific health concerns prior to travel.

Copyright

We respect intellectual property rights and expect our users to do the same. It is our policy to terminate, where appropriate, the accounts of users who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

Unless otherwise stated, the software used for our services and the intellectual property rights in the content, data, and materials on our Website are owned by us or our suppliers.

You may use materials from the Website for your personal use only. Except where permitted under copyright law or with our explicit written permission (and that of the copyright holder, if applicable), you may not reproduce, redistribute, publish, or commercially exploit any content.

Any authorized use of copyrighted materials must preserve all legal notices and attribution, including copyright and trademark statements. Downloading content does not transfer ownership rights to you.

Unauthorized use or infringement of these rights will be considered a serious violation of our intellectual property rights.

Jurisdiction and Governing Law

By accessing or using the Website and Services, you agree that these Terms and Conditions are governed by the laws of Croatia, without regard to conflict of law principles.

Any disputes arising between you and the Company or its affiliates shall be brought exclusively before the courts located in the City of Zagreb, Croatia. You consent to the jurisdiction of these courts and waive any objection based on lack of jurisdiction or inconvenient forum.

EXCEPT AS OTHERWISE PROVIDED FOR SPECIFIC SERVICES IN ANY APPLICABLE TERMS, YOU AND THE COMPANY AGREE THAT THE SOLE AND EXCLUSIVE VENUE FOR ANY CLAIMS OR DISPUTES RELATING TO THESE TERMS, THE WEBSITE, OR THE SERVICES SHALL BE SUBJECT TO CROATIAN LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT NO CLAIM UNDER THESE TERMS MAY BE JOINED WITH ANOTHER CLAIM OR ARBITRATION, INCLUDING THOSE INVOLVING OTHER USERS, AND THAT CLASS ACTIONS ARE NOT PERMITTED.

General Provisions

Unless stated otherwise, terms such as "including," "includes," or "for example" shall be interpreted to mean "without limitation."

Capitalized terms used in these Terms and Conditions have the meanings ascribed to them herein.

Any feedback, suggestions, questions, or ideas you provide regarding the Website or Services will be considered non-confidential and become the exclusive property of the Company. We shall have full rights, including intellectual property rights, to use and disseminate such feedback for any purpose, commercial or otherwise, without compensation or acknowledgment.

These Terms and Conditions constitute the entire agreement between you and the Company concerning the use of the Website and Services, and supersede any prior agreements.

Our failure to enforce any provision of these Terms shall not be considered a waiver of that provision or any other.

If any part of these Terms is held to be invalid, unlawful, or unenforceable, that portion shall be severed, and the remaining provisions shall remain valid and enforceable. In such cases, you and the Company agree to replace the invalid provision with one that most closely reflects its original intent and is enforceable under applicable law.

Any rights not expressly granted herein are reserved.

This Agreement is effective upon your use of the Website or Services and remains in effect unless terminated in accordance with its terms.
