Seagull-Experience (collectively, the “Site”, “Website”) is an online service that enables users to research, discover, and book travel experiences across Croatia. Seagull-Experience is operated by Elrem d.o.o., along with its corporate affiliates (collectively, "us", "we", or "the Company").

The Website provides a range of tourist packages, accommodations, excursions, activities, tickets, and other related services (collectively referred to as “products” or “tourist services”) offered either directly by us or through our verified partners and suppliers.

Whether you’re a seasoned traveler or planning your first trip, our goal is to provide you with a user-friendly platform and high-quality service to help you easily plan and book an unforgettable experience in Croatia.

By using this Website, you (“the User”) agree to these Terms and Conditions (“Agreement”) without modification.

If we detect suspicious, abusive, or fraudulent booking activity associated with your account, we reserve the right to cancel those bookings and pursue legal remedies, including claims for damages and legal fees.

When you use the Website, or send e-mails, messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically and agree that we may communicate back with you in a variety of ways you’ve initiated. Products and Booking Reservations

By booking any Product through our Website, you confirm that you accept the practices described in this Agreement and in our Privacy Policy. You also affirm that you are at least 18 years old, have the legal authority to enter into this Agreement, and that all information you provide is truthful and accurate. You agree to use this Website solely for legitimate bookings for yourself or for others whom you are legally authorized to represent. Making false or fraudulent reservations is strictly prohibited and may result in denial of services.

Seagull-Experience facilitates bookings for transportation, accommodations, tours, excursions, and other travel experiences that are delivered by third-party providers. By placing a reservation, you agree to engage the services of these suppliers at your own risk. We are not liable for any acts, omissions, errors, representations, warranties, breaches, or negligence by suppliers, nor for any resulting personal injury, death, property damage, or other losses incurred during your interactions with them.

We strongly encourage you to review our Cancellation, (pre)payment, and no-show policies carefully. Verify all relevant details—such as prices, room types, rates, availability, and dates—before completing your reservation, and ensure timely payment where applicable.

Modifying or Amending Your Booking

All change requests must be submitted via email to our Customer Service at info@seagull-experience.com. Requests sent directly to the service provider will not be processed. This applies to any modifications, including date changes, extended stays, early departures, late arrivals, or full/partial cancellations. For cancellations, refer to the “Cancellations and Refunds” section below.

Pricing & Inclusions/Exclusions

Prices shown on the Website include VAT unless stated otherwise. All rates are listed per person unless noted differently.

Prices are subject to change without notice until your booking is confirmed. They generally do not include gratuities for guides or drivers, visa/passport fees, personal insurance, personal expenses, local taxes or duties, or any food or drinks not explicitly mentioned in the “Inclusions” section of the product listing.

Please review all details thoroughly before making a reservation. All listed prices apply only to the specified stay dates and number of guests unless stated otherwise. Promotions or special offers will be clearly marked.

For "on-request" reservations (i.e., bookings not confirmed in real time), we will process your request within two business days (excluding Saturdays). You will be notified in writing about the final availability and price. If you do not receive confirmation within that period, the requested service is either unavailable or could not be processed due to a technical error. You may always contact our Customer Service for verification.

Payment

PAYMENT SCHEDULE

Once your reservation is confirmed, a 30% deposit must be paid within 24 hours (excluding weekends and holidays) for the reservation to remain valid. The remaining 70% must be paid no later than 21 days before your arrival, unless specified otherwise.

For bookings made within 21 days of your arrival, the full amount must be paid within 24 hours (excluding weekends and holidays) to confirm the reservation.

PAYMENT METHODS

Bank Transfer:

If you choose to pay by bank transfer, the required amount must be paid within 24 hours from receiving your confirmation, and proof of payment must be sent to us. Otherwise, we reserve the right not to process your reservation. We are not liable for incomplete reservations caused by missing or delayed payment confirmations. All bank transfer fees are the responsibility of the client (please select "OUR" for charge details). Incomplete payments will invalidate your reservation.

Bank transfer is not available for:

- International payments if arrival is within 5 business days
- Domestic (Croatian) payments if arrival is within 3 business days

In these cases, payment must be made via credit/debit card.

Cancellations and Refunds

When you make a reservation, your payment will be processed as outlined above. If you cancel, any refund or charge will be subject to the cancellation, prepayment, and no-show policy associated with your reservation.

Unless stated otherwise in your booking confirmation, our standard cancellation policy is as follows:

- Cancellations made 30 days or more before arrival: 7% charge
- Cancellations made 29 to 22 days before arrival: 30% charge
- Cancellations made 21 to 15 days before arrival: 50% charge
- Cancellations made 14 days or less before arrival: 100% charge

If your balance payment is not received 21 days before your arrival, or immediately upon booking for last-minute reservations, your booking will be automatically cancelled, and the deposit will be retained per the above policy.

Failure to show up without prior notice will be treated as a late cancellation and incur a 100% charge.

If we are forced to cancel your confirmed booking due to force majeure or service unavailability, we will issue a full refund of any collected payments within 30 days and provide alternative options and updates via email or other communication.

Vouchers

You will receive a personalized booking voucher (“Voucher”) via email for each reservation. You must present this original, valid voucher to the corresponding service provider in order to redeem your accommodation, excursion, or other travel services. Reservations cannot be honored without a valid voucher.

Liability Disclaimer

Seagull-Experience makes no guarantees regarding the suitability, accuracy, or availability of the content, software, products, or services on this Website. All services and content are provided “as is” and “as available”, without warranties of any kind.

We do not guarantee that:

- The Website or services will operate uninterrupted or error-free
- Information presented is accurate or up-to-date
- The Website or communications are free of viruses or harmful elements

You use this Website and all associated services at your own risk. We are not responsible for damages resulting from use of the site or services, including—but not limited to—data loss, hardware damage, system errors, or service interruptions.

We are not liable for the actions or omissions of third-party providers. All such providers are independent contractors, not employees or agents of the Company. Any claims, delays, cancellations, overbookings, or force majeure events beyond our control do not entitle you to compensation or refund, unless explicitly stated otherwise.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its respective officers, directors, employees, and agents from and against any and all claims, causes of action, demands, legal proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and liabilities of any kind or nature, including but not limited to reasonable legal and accounting fees, that arise out of or relate to:

1. Your breach of this Agreement or any referenced documents;
2. Your violation of any applicable law, regulation, or guideline;
3. Your infringement, misappropriation, or violation of any third-party rights, including rights of publicity or privacy;
4. Your use of this Website;
5. Your booking or use of any Products obtained via this Website; or
6. Your negligence or intentional misconduct.

Passports, Visas, and Other Travel Documentation

You are solely responsible for meeting all passport, visa, travel insurance, and health documentation requirements. We disclaim all responsibility for any denial of boarding, travel, or entry into a destination, or for any costs, delays, or losses incurred due to irregularities or deficiencies in such documentation.

If you have questions regarding documentation or insurance, you must contact us well in advance of your trip. Any information we provide in this regard is offered in good faith but without liability on our part.

As visa and health requirements may change without notice, we strongly recommend checking with the appropriate consulate or authority prior to departure.

We also strongly advise purchasing a comprehensive travel insurance policy before traveling. In the event of a cancellation or change in travel dates, your policy may cover cancellation fees and other related costs.

Health Precautions and Safety

We may provide general information regarding required or recommended vaccinations and health precautions for your destination or activity. However, it is your responsibility to confirm these requirements with qualified medical professionals and ensure you have received any necessary or advised vaccinations or medication.

We reserve the right to request proof of such vaccinations or treatments and may cancel your participation—without refund—if these requirements are unmet.

It is also your responsibility to take any required medication before, during, and after your trip. Any health-related information we provide is general in nature and not a substitute for personalized medical advice. You should consult your own doctor with any specific health concerns prior to travel.

Copyright

We respect intellectual property rights and expect our users to do the same. It is our policy to terminate, where appropriate, the accounts of users who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

Unless otherwise stated, the software used for our services and the intellectual property rights in the content, data, and materials on our Website are owned by us or our suppliers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT NO CLAIM UNDER THESE TERMS MAY BE JOINED WITH ANOTHER CLAIM OR ARBITRATION, INCLUDING THOSE INVOLVING OTHER USERS, AND THAT CLASS ACTIONS ARE NOT PERMITTED.
